Introduction
Starting May 25, 2018, European Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and the free movement of such data ("the Regulation" or „GDPR”) is applicable. Its main purpose is to increase the level of protection of personal data and create a trustworthy climate that allows each person to control their own data.

This privacy policy regards the personal data of our clients, business partners, other persons contacting and visiting us and of the representatives thereof, potential employees, interns, associates and it applies to data collected through our website, www.almaj.eu, as well as to all other personal data we collect through e-mail or other off-line contacts.

What is personal data

What does the processing of personal data means
It means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Principles of Personal Data Processing
In addition to respecting the confidentiality and professional secrecy governing the profession of lawyer, we process the data we collect by observing the following principles strictly imposed by the GDPR:
Lawfulness, Fairness and Transparency – your personal data will be processed “lawfully, fairly and in a transparent manner”;
Purpose Limitation – your data will be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
Data Minimization – any collection of personal data will be very well analyzed before the actual request for such data we are going to process, which shall be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

Storage Limitation – personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving the purposes for which they are collected;

Types of Processed Personal Data
Contact information such as your name, job title, postal address, including your home address, if you have communicated it to us, your business address, telephone number, mobile phone number, fax number and address e-mail, bank account and other financial information;
Additional information processed in the context of a contractual relationship with us or communicated voluntarily by you, such as: instructions given, payments made, information on any legal issues, disputes, litigation or other court action in which you are involved in any capacity - defendant, plaintiff, lawyer of the parties, consultant, expert, etc.;
In the context of our services, we may also collect and process special categories of personal data such as: union membership data, health data, data about your political opinions, data on criminal convictions and offenses, health status, diagnosis, national identification numbers (personal identification number, series and number of ID cards, passports, etc.);

Legal grounds for the processing of personal data
Processing is required for the conclusion or performance of a contract to which you are a party;
Processing is necessary to comply with a legal obligation of the operator;
Processing is done under your consent;
Processing is necessary to protect the vital interests of you or of another individual;
Processing is necessary for the legitimate interests of Almaj, Iordache or a third party, unless your interests or fundamental rights and freedoms prevail over those interests;
In the case of special categories of data, processing will be done if, besides a general legal basis for data processing, one of the following specific processing conditions is met:

Purposes of processing
Performance of contractual relationships with our clients, professional communications, recruitment.
Fulfillment of tax obligations related to the payment of the fee, drafting the documents in your name, according to the mandate entrusted, forward to courts and other institutions, authorities, organizations and individuals in Romania and from other countries as a representative or solicitor of claims and other documents necessary to carry out the mandate entrusted, fulfilling the obligations imposed by the law on the lawyers, fulfillment of our professional obligation to keep records of contracts concluded, achieving your legitimate interest in legal assistance and representation attorney, achieving the public interest of rendering lawyers' services and the legitimate aims of the advocate.
For any purpose which is ancillary to any of the foregoing, or to any other purpose for which your personal data has been provided to us, in compliance with applicable law.
Disclosure of personal data
Almaj, Iordache may disclose your personal data to other legal professionals (including mediators, industrial property advisers), consultants or experts involved in the cases we manage and in the services we provide, courts or arbitration courts, as well as other public authorities, entities designated by you, parties involved in your case (which may be our client or a third party involved) or other entities in the context of providing our services (such as insurance providers, cloud providers, telephony, e-mail, etc.).
Almaj, Iordache will conclude contracts with different entities providing services to us, which will properly address the requirements of relevant privacy laws, depending on the actual situation. These entities will be required to use and implement appropriate security measures to protect personal data. These entities will be prohibited from using these data in a manner other than the one we received in our instructions.
Data transfers

Almaj, Iordache does not intend to transfer data to third countries. Almaj, Iordache will do its utmost to protect your personal data held in our possession or control by establishing adequate security measures in order to prevent unauthorized access, collect, use, disclose, copy, modifycation or deletion, as well as other similar risks.
Storage of your personal data
Personal data processed for the purposes herein will only be retained for as long as is necessary for your relationship with us and subsequently for the retention periods imposed by applicable law. Where legal action is initiated, your personal data may be retained until the end of this action, including any appeal period and then deleted or archived in accordance with applicable law.
We will keep your personal data for as long as required or permitted by applicable law. Subsequent to the expiration of these periods or the exercise of one of your rights, in accordance with the law, we will remove your personal data from our systems and records and / or take steps to anonymize them so that you can not be identified based on them.
In all cases, we will retain your personal data for as long as it is necessary to fulfill the purpose of processing such data.
The rights of the data subject
The right to be informed, access (the data subject has the right to obtain from us a confirmation that personal data concerning him / her are processed or not, and, if so, he / she has the right to access the data).

This right may be limited or refused, the reason for the refusal or limitation being communicated to the person concerned.
The right to restrict processing - the data subject has the right to restrict the processing in the following situations:
(i) contest the accuracy of the data for a period that allows the operator to verify the accuracy of the data;
(ii) the processing is illegal and the person concerned opposes the deletion of personal data, but instead calls for the restriction of their use;
(iii) no personal data is required for processing, but the data subject requests them for the establishment, exercise or defense of a right in court;
(iv) the data subject opposed to the processing, for the period of time to verify that the legitimate interests of the operator prevail over the rights of the person.
The user has the right to oppose at any time data processing for direct marketing purposes, not to be subject to the automated decision making process, including profiling - does not have this right if the decision:
(i) is required to conclude or execute a contract between the person concerned and us;
(ii) is authorized by Union or national law applicable and which also provides for appropriate measures to protect the legitimate rights, freedoms and interests of the data subject;
(iii) is based on the explicit consent of the data subject
Right to data portability - the data subject has the right to receive the personal data which he regards and which he has provided in a structured, commonly used and readable form and has the right to request us to transmit this data to another operator, without obstacles, if the following conditions are met cumulatively:
(i) processing is based on consent or contract and
(ii) processing is carried out by automatic means, in particular if this is technically feasible
